Franking Facility Through Postal Department

Maharashtra State Government has provided the facility to the public for the payment of Stamp Duty through franking the documents at the Post Offices. This facility is availed at limited Post Offices in the State of Maharashtra. The details of Post Offices who are franking documents are as under.

ORDER

The Inspector General of Registration and Controller of Stamps have passed in his ORDER NO D-/STP/CASE NO. 6/14/106/2014 DATE: 15/03/2014 stating that the franking shall be of Rs. 5000/- for a single document and it cannot be franked above Rs 5000/- either at the government stamp office or authorised banks or its agents.

WHEREAS the use of franking machines for payment of stamp duty is allowed to be introduce under the provision of the Maharashtra Stamp Act, 1958 and Maharashtra Stamps Rules 1939;

AND WHEREAS, the Chief Controlling Revenue Authority, Maharashtra State is empowered to approve the models and authorized the use of the said machine for the payment of Stamp Duty in the State of Maharashtra by laying down procedure and prescribing terms and condition for such use;

AND WHEREAS, the Government of Maharashtra vide its resolution, Revenue and Forest Department No. Mudrank-2003/1358/C.R.356/M-I dated the 26th March 2004 has increased the scope of use of franking machine by allowing Banks, Post Offices and Financial Institute to vend stamps to the public by using Franking Machine or any such Machine authorized in this behalf.

AND WHEREAS, the Undersigning Authority had prescribed the procedure for proper officer Authorized vendors and Authorized users vide Order No. D-5/STP/CASE NO 70/04/2332/04 dated 01/10/2004 for the use of Franking Machine or any such machine, for payment of Stamp Duty in the State of Maharashtra.

AND WHEREAS the Undersigning Authority, is of the opinion that in the present circumstance, it has become necessary to partially modify the existing rules laid down by the above referred Order.

NOW THEREFORE, in the exercise of power vested in the undersigned under Section 10(2A), 10(2B), and 10(2C) of Maharashtra Stamp Act, 1958 and under provision to Sub-Rule (2) of Rule (3) of the Maharashtra Stamps Rules 1939, the undersigning Authority hereby modifies the above referred order as mentioned below:-

Part I Procedure Regarding Use of Franking Machine by Proper Officer

Existing Rule 5(13) shall be deleted and submitted as follows.

Rule 5(13) “Maximum limit for paying stamp duty by franking on single document shall be Rs 5000/-”

Part II Procedure Regarding Use of Franking Machine by Authorised Users

New Rule 5(6) shall be added as follows.

Rule 5(6) “Maximum limit for paying stamp duty by franking on single document shall be Rs 5000/-”

Part III Procedure Regarding Use of Franking Machine by Authorised Vender

Existing Rule 5(5) shall be deleted and submitted as follows.

Rule 5(6) “Maximum limit for paying stamp duty by franking on single document shall be Rs 5000/-”
